Welcome to GutCall. By downloading or using the app, you agree to these Terms. Please read Section 12 (Dispute Resolution) carefully — it requires most disputes to be resolved by individual arbitration and waives class actions.
GutCall is a game in which you predict the movement of self-generated charts and earn in-game points. It is provided for entertainment and education.
GutCall is not investment, trading, tax, or financial advice, and nothing in the app is a recommendation to buy, sell, or hold any security or instrument. Charts are self-generated by the game. Markets involve risk. Any decisions you make in real markets are your own.
In-game points, streaks, rankings, and virtual items have no monetary value, are not currency, and cannot be redeemed, withdrawn, transferred, or exchanged for money or anything of value. GutCall is a game of skill for entertainment; it is not gambling and involves no wagering of money.
You must be at least 13 years old to play. You may play anonymously or create an optional account. You agree not to cheat, reverse-engineer, disrupt, or abuse the service, use bots or automated play, or infringe others' rights. We may suspend or terminate access for violations.
Playing GutCall generates gameplay data: your answers, confidence stakes, position and structure choices, timing, scores, streaks, ratings, and duel results. You grant GutCall LLC a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to collect, store, reproduce, analyze, transform, aggregate, de-identify, and otherwise use gameplay data for any lawful purpose — including operating and improving the game, calibrating difficulty and ratings, academic and commercial research, and the development, testing, and operation of financial-market research, models, and trading strategies.
Where gameplay data is used beyond operating the game, we use it in aggregated or pseudonymized form as described in our Privacy Policy, and we do not re-identify it. This license survives termination or deletion of your account as to data that has been aggregated or pseudonymized so it no longer identifies you; on deletion we also purge or unlink your rows from retained research extracts as described in the Privacy Policy. This section transfers no rights to your name, likeness, or identity, and nothing in the game creates an advisory, fiduciary, employment, or partnership relationship between you and GutCall LLC — in either direction: your predictions are game answers, not investment advice to us or anyone else.
The app is free to play and may be supported by ads and optional in-app purchases (e.g., consumables, ad removal). Purchases are processed by Apple or Google and subject to their terms; refunds are handled through them. Advertising is subject to our Privacy Policy.
GutCall, its name, design, and content are owned by GutCall LLC. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app for your own non-commercial enjoyment.
We respect intellectual property rights. If you believe content in the app infringes your copyright, send a notice to legal@playgutcall.com including: your contact information; identification of the copyrighted work; identification of the allegedly infringing material and where it is; a statement that you have a good-faith belief the use is unauthorized; a statement, under penalty of perjury, that your notice is accurate and you are authorized to act; and your signature. We will respond as required by the DMCA.
The app is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that it will be uninterrupted, error-free, or that any data is accurate.
To the fullest extent permitted by law, GutCall LLC and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or trading losses, arising from your use of the app or any decisions you make. Our total aggregate liability will not exceed the greater of the amount you paid us in the past 12 months or USD $50.
You agree to indemnify, defend, and hold harmless GutCall LLC and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the app; (b) your violation of these Terms; (c) your violation of any law or the rights of any third party; or (d) any decision you make in real markets.
Please read this section carefully; it affects your legal rights.
Informal resolution first. Before starting arbitration, you agree to contact us at legal@playgutcall.com and give us 30 days to try to resolve the dispute informally.
Binding arbitration. Except as noted below, any dispute arising out of or relating to these Terms or the app will be resolved by binding individual arbitration administered by a recognized arbitration provider (such as the American Arbitration Association) under its consumer rules, rather than in court. The Federal Arbitration Act governs this section. Judgment on the award may be entered in any court with jurisdiction.
Class-action waiver. You and GutCall LLC agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims.
Exceptions. Either party may (a) bring a qualifying claim in small-claims court, and (b) seek injunctive or equitable relief in court to protect intellectual property or confidential information.
Opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing legal@playgutcall.com with your name and a statement that you opt out. Opting out does not affect the other provisions of these Terms.
We respect intellectual property rights and expect the same of players. If you believe content available through GutCall infringes your copyright, send a notice to our designated agent, registered with the U.S. Copyright Office (Registration No. DMCA-1075284):

Your notice must include: (1) identification of the copyrighted work claimed to be infringed; (2) identification of the allegedly infringing material and where it appears in our service; (3) your name, address, telephone number, and email; (4) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; (5) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act for the owner; and (6) your physical or electronic signature. We will remove or disable access to material identified in valid notices and may terminate repeat infringers' access. If your content was removed by mistake or misidentification, you may send a counter-notice with the elements described in 17 U.S.C. § 512(g)(3).
We may update these Terms or the app at any time; continued use after changes means you accept them. You may stop using the app at any time.
These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-laws rules, except that the Federal Arbitration Act governs Section 12.
